The WV Chapter is considering a range of appeal strategies and tactics, but we firmly intend to move forward as expeditiously as possible. TrAILCo indicated that they intend to start work "immediately" once they have the certificate from the PSC, but the PSC certificate is contingent on them getting approval from all three states, as the alternative would leave them with potentially huge stranded costs if they sink significant dollars into construction here, and other states block or re-route the line. (Are you surprised that TrAILCo's PR people would misrepresent this to the news media?)
Meanwhile, the WV Governor Joe Manchin is making a big deal of his proposed "transmission tax" which is intended to reimburse WV ratepayers for any added costs associated with rate increases imposed by PJM or FERC to pay for TrAILCo, and Allegheny Energy's President was quoted this week as supporting that tax (probably only after significant arm-twisting by Go. Manchin). You may wish to point out that this would further increase the costs to Virginia ratepayers, as TrAILCo would certainly try to recover the cost of the tax from other ratepayers, plus their 12+ % incentive rate of return, yet another increase in the cost to ratepayers. Obviously, TrAILCo should have no objection to a transmission tax, if they make !2 % on every tax dollar they pay.
