Attached are comments on EPA's coal ash rule from Tennessee. Of particular interest is Attachment 3 which is a bill introduced in the TN legislature last year to regulate coal ash.
The comments identify eight issues that are covered in the bill that ought to apply to the so-called beneficial use disposal sites in WV. As far as I can tell, the Tennessee bill does not address the issue of adequate testing of coal ash, and appears to allow continued reliance on the discredited TCLP methods to test for toxicity of ash leachates.
Does anyone see any other issues that need to be addressed? I hope to begin drafting some legislation over this coming week, and any comments (or help drafting) would be appreciated.
