On Friday, the Commission granted our petition to intervene but denied the request for a hearing. Order attached.
Happy to discuss tomorrow, but I don't see much value in pushing any further for a hearing given this decision. Also, if I'm understand Jackie's thinking correctly, it's that we'll have a better chance to challenge a request to transfer ownership in the Pleasants plant in a future proceeding if less happens at this stage. That is, if a hearing were held now, that could put FE in a better position with respect to the asset transfer because they could argue that the transfer was contemplated in the IRP and a hearing was held, etc etc.

Thanks for the update, I had not seen the Order, and it raises the question of why the newspaper ran the article on Sunday (saying FE does not want a hearing), if FE already had an Order on Friday denying the request for a hearing. The timing of the Order, a week before the close of the comment period, leaves our timetable in question. We assumed that doing a publicity event two days before the deadline to intervene would be OK.
So what do we do with an "event" now? I am not clear on what the best message is. We certainly want to submit the letters generated by our members, but a consistent media message would be helpful.
