Last night, the Frederick County, MD Board of Zoning Appeals _denied_ a special zoning exception that would have allowed the construction of the huge Kemptown Substation at the eastern end of PATH.
This is a serious setback for PATH. Allegheny will no doubt go to state court to fight this. The MD PSC has already claimed sole authority to site the substation in Frederick County, although state law may not let them do that. There will clearly be a major court fight pitting the Frederick County Commission against AEP/Allegheny and the MD PSC. This will cause serious problems for PATH in MD.
