On Feb. 27, the NPS denied PATH's request for continued, indefinite abeyance of their application and thereby denied PATH's permit without prejudice. See letter from NPS here ( http://www.stoppathwv.com/documents/NPS-PATH-Denial.pdf ).
If this is old news to any of you, pardon the duplication, however it's news to us. NPS sat on this information and only posted it on the project website some time after March 15, without any notice.
If PATH is resurrected, they have to submit a new application for an EIS. This is the second of PATH's three lifelines that has been cut. They failed to file further appeals on the Frederick Co., MD, BZA decision at the end of March, so that process is over, with the BZA denial standing.
