AEP transmission venture with Allegheny files to establish FERC rate for PATH transmission project COLUMBUS, Ohio, Dec. 28, 2007 – American Electric Power (NYSE: AEP) today announced that Potomac-Appalachian Transmission Highline LLC, AEP’s transmission joint venture with Allegheny Energy (NYSE: AYE), has filed with the Federal Energy Regulatory Commission (FERC) to establish a transmission rate to recover costs for the approximately 290-mile, extra-high voltage transmission line that the companies propose to build from West Virginia into Maryland. The companies are seeking a transmission cost-of-service formula rate, effective March 1, 2008, that will provide for annual updates to the amounts that PJM Interconnection (PJM), an independent regional transmission operator, will charge utilities to recover the costs of the project. The proposed rate includes recovery of a return on construction work in progress (CWIP) for the project and a return on equity of 14.3 percent, which includes an incentive award, consistent with federal policy to encourage significant transmission infrastructure and technology improvements. AEP and Allegheny each separately received FERC approval for incentive rate treatments for individually proposed transmission projects that ultimately became the joint Potomac-Appalachian Transmission Highline (PATH) project. The PATH project includes approximately 244 miles of 765-kilovolt (kV) extra-high voltage transmission from AEP’s Amos substation near St. Albans, W.Va., to Allegheny’s Bedington substation, northeast of Martinsburg, W.Va. Another 46 miles of twin-circuit 500-kV transmission will be constructed from Bedington to a new substation to be built near Kemptown, southeast of Frederick, Md. The total project is estimated to cost approximately $1.8 billion. PJM identified June 2012 as the date by which the PATH project needs to be operational. “The PATH project addresses significant reliability concerns in the region, including overloads that will occur on more than thirteen existing transmission lines in Maryland, West Virginia, Virginia and Pennsylvania, as soon as 2012 if PATH is not built,” said Michael G. Morris, AEP chairman, president and chief executive officer. “Establishing FERC rates for the project will provide the timely cost recovery necessary to obtain financing and allow us to move forward and bring the project on line in time to help prevent overloads on these lines.” Once approved by FERC, the costs of the PATH project will be allocated to all electric utilities who serve retail customers in the PJM region. AEP and Allegheny plan to begin work on the routing study and environmental assessment for the PATH project in January 2008. The companies anticipate seeking regulatory approvals for the project from the utility commissions in both West Virginia and Maryland in the fourth quarter of 2008, following the completion of the routing study. TrAIL?Multistate Power Line Proposal Stirs W.Va. Controversy Posted on: Tuesday, 19 February 2008.? Charleston Gazette. Plans for a $1.3 billion power line across northern West Virginia continue to stir controversy, and more such projects are likely on the way. The state Public Service Commission is scheduled to issue a ruling by May 2 on Allegheny Energy's proposed Trans-Allegheny Interstate Line, or TrAIL. The 240-mile transmission line would carry electricity from western Pennsylvania across West Virginia and into Virginia. Allegheny wants the PSC to approve the 114 miles of the line that run through West Virginia. TrAIL would enter the state north of Morgantown, and run south and east through Monongalia, Preston and Tucker counties to Mount Storm in Grant County. Then, it would turn east through Hardy and Hampshire counties before entering Virginia. Allegheny officials say the line is needed to provide cheap and reliable power to big Eastern cities and their growing suburbs. Aging infrastructure, combined with increasing demand, could cause ?rolling blackouts by 2011 that would extend into eastern West Virginia, power company officials say. ? Commissioners Jon McKinney and Ed Staats are hearing the case. PSC Chairman Michael Albert, appointed last year by Gov. Joe Manchin, recused himself. Albert said he did some work on the project for Allegheny Energy before leaving the Jackson Kelly law firm for the PSC post. The project has drawn intense opposition from hundreds of West Virginians, who fear it will mar scenic views, lower their property values and otherwise damage rural communities. Project opponents are especially upset that Allegheny could get PSC approval to use the power of eminent domain to force residents to give the company rights of way for the power line. They are also worried that if the PSC doesn't approve the project, or waits too long to decide, the federal government might take over the permitting process under a 2005 law meant to encourage new power lines. The PSC staff and the agency's consumer advocate have also objected to parts of the power line proposal. In early January, the consumer advocate agreed to drop part of its objections in exchange for Allegheny promising to provide free electricity to residents along the power line path. The company also agreed to limit clearcutting and not use aerial herbicide spraying to maintain its right of way. PSC consultants have argued the Allegheny proposal is not "the most economical or cost-effective means" to cure potential northeast power outages, and a PSC staff engineer concluded the company did not choose the best and least environmentally damaging route. Developers of two natural gas-fired power plants proposed for Virginia and Maryland are also fighting the TrAIL proposal. Competitive Power Ventures Inc. argues its plants would eliminate the need for the 500-kilovolt transmission line. Reports from CPV Warren experts, filed with the PSC, conclude the gas-fired plants are a better solution to electrical reliability problems identified by PJM Interconnections, a private organization that maintains the regional power grid. "If the generation resource cap is in the East, build generation resources, such as CPV Warren, in the East, not a massive transmission line such as the one proposed here to support the delivery of power and energy from existing and proposed generation in the West," George C. [CLEANBRIER] meager update

Hello fellow lovers of clean air and water, No news is good news? I'm not ready to relax completely and assume the Western Greenbrier CoGen plant is dead, but there have been no vehicles at the site for months now, except Wayne Brown's a couple of times. Neely, the young gung ho employee, is gone, is selling his home and word is he is going back to his old job. Even if it is dead, it rankles that the taxpayers footed the bill for several years of fat salaries and pie-in-the-sky visions. It sure would be nice if the press would do their job and expose this boondoggle for what it is/was. The next problem is that there has been a permit issued for a mountaintop removal project in western Greenbrier Co. We are finally getting the low-rate green bags for people to use and will need to distribute them. We will have a meeting in March to pass out the bags, share news and decide what to do next. IF ANYONE FINDS OUT ANYTHING FROM RAINELLE, RUPERT OR QUINWOOD TOWN COUNCILS, COUNTY COMMISSIONERS, ETC. ABOUT THE STATUS OF THE PROJECT, PLEASE FORWARD THE INFORMATION. This was entered to stop some unappropriate land uses in residential areas eg. a Shale mine in Gerrardstown in Berkeley Cty (E. Panhandle). I want to put an article in the NL and ask folks to contact the committee chairs. thanks, paul * Be it enacted by the Legislature of West Virginia:* That §8A-7-10 of the Code of West Virginia, 1931, as amended, be amended and reenacted to read as follows: *ARTICLE 7. ZONING ORDINANCE. **§8A-7-10. Effect of enacted zoning ordinance.* (a) After enactment of a zoning ordinance by a municipality or county, all subsequent land development must be done in accordance with the provisions of the zoning ordinance. (b) All zoning ordinances, and all amendments, supplements and changes thereto, legally adopted under any prior enabling acts, and all actions taken under the authority of any such ordinances, are hereby validated and continued in effect until amended or repealed by action of the governing body of the municipality or the county taken under authority of this article. These ordinances shall have the same effect as though previously adopted as a comprehensive plan of land use or parts thereof. (c) Land, buildings or structures in use when a zoning ordinance is enacted can continue the same use and such use cannot be prohibited by the zoning ordinance so long as the use of the land, buildings or structures is maintained, and no zoning ordinance may prohibit alterations or additions to or replacement of buildings or structures owned by any farm, industry or manufacturer, or the use of land presently owned by any farm, industry or manufacturer but not used for agricultural, industrial or manufacturing purposes, or the use or acquisition of additional land which may be required for the protection, continuing development or expansion of any agricultural, industrial or manufacturing operation of any present or future satellite agricultural, industrial or manufacturing use. A zoning ordinance may provide for the enlargement or extension of a nonconforming use, or the change from one nonconforming use to another. (d) If a use of a property that does not conform to the zoning ordinance has ceased and the property has been vacant for one year, abandonment will be presumed unless the owner of the property can show that the property has not been abandoned: *Provided,* That neither the absence of natural resources extraction or harvesting nor the absence of any particular agricultural, industrial or manufacturing process may be construed as abandonment of the use. If the property is shown to be abandoned, then any future use of the land, buildings or structures must conform with the provisions of the zoning ordinance regulating the use where the land, buildings or structures are located, unless the property is a duly designated historic landmark, historic site or historic district. (e) Nothing in this chapter authorizes an ordinance, rule or regulation preventing, outside of urban areas, the complete use of natural resources by the owner. *(f) Any county which has enacted county-wide zoning and which has been designated as a "growth county" as defined in section three, article twenty, chapter seven of this code may: (1) Limit the use of land presently owned or subsequently acquired by any farm, industry or manufacturer and not presently or subsequently used for energy related industrial or manufacturing purposes, to those uses permitted by the applicable zoning ordinance, notwithstanding the provisions set forth in subsection (c) of this section; (2) Limit the use of abandoned property to the provisions of the zoning ordinance where such property is not being used for energy related natural resources extraction or harvesting or where there is no particular agricultural, energy related industrial or manufacturing process on the land, and where such property has been (d) of this section; and (3) Limit or prohibit the complete use of nonenergy related natural resources by an owner of property, if such use of the property does not conform to the provisions of the applicable zoning ordinance.* NOTE: The purpose of this bill is to limit the use of some lands for nonenergy related purposes in "growth counties." February 10, 2008 New York Times Editorial Clean Power or Dirty Coal? Opposition to new coal-fired power plants built without new technology — that is, without the capacity to capture greenhouse gas emissions — is rising on both Wall Street and Main Street. Citizen opposition has led companies to cancel some high-profile projects, including a proposed plant near the Florida Everglades. Pressure from environmental organizations has persuaded major banks to begin weighing the risks of global warming when deciding whether to finance new plants. This is good news. Coal-fired power plants are big contributors to global warming. In the United States alone, they generate half the country's electricity and nearly a third of its emissions. Meanwhile, scientists have left no doubt that the world has just a few years to make deep cuts in emissions or begin to suffer the worst consequences of rising temperatures. This means that scientists will have to figure out a way to capture carbon dioxide from coal plants, or coal will have to be replaced with cleaner fuels. Given that task, the failure — by both the Bush administration and Congress — to encourage alternative sources of power is distressing. Bowing to veto threats from the White House, Congress stripped from an otherwise admirable energy bill two important provisions on alternative fuels. One would have required states to generate an increasing share of their power from renewable sources like wind and solar energy. The other would have rolled back about $12 billion in wholly unnecessary tax breaks for the oil industry and used the proceeds to develop cleaner fuels and new energy technologies. There is a way that Congress can quickly begin to make amends. That is to extend important tax breaks for alternative energy sources that are set to expire at the end of this year. These incentives have been critically important to the development of wind and solar power; wind power has become increasingly cost-competitive with natural gas, although not yet with coal. Investors are unlikely to pump much new money into clean power unless they are sure the credits will be available next year. The American Wind Energy Association has already detected a drop in new capital spending. As we have said before, the surest and probably the only way to encourage meaningful and swift commercial development of cleaner fuels and energy sources is to put a stiff price on carbon emissions. That, in turn, would inspire — indeed require — industry to invest heavily in energy efficiency and low-carbon fuels. But until Congress sets such a price, through a carbon tax or a cap-and-trade program — and it is a long way from doing so — every effort should be made to encourage the development of alternative energy sources. Ted Nace, founder of Coal Moratorium NOW! said, "Although we knew that many plants were being nixed, we were stunned by the total number. It spells real hope for the movement seeking to blunt the coal rush." Because coal is the largest contributor to the human-made increase in atmospheric carbon dioxide, coal plants are at the top of the list of global warming threats cited by climate scientists. Dr. James Hansen, director of NASA's Goddard Space Center, the world's largest climate research agency, told Congress on April 26, 2007, that a moratorium on new coal plants is "the most critical action for saving the planet at this time." Among the study's conclusions: * * · *Climate concerns played a role in at least 15 plant cancellations.*These included five plants in Florida, where Gov. Charlie Crist has made global warming a top issue; a three-unit plant in Kansas opposed by Gov. Kathleen Sibelius; and several plants affected by strict new carbon regulations in western states. * * · *Coal plants disappeared entirely from some utilities' long-range plans:* Increasingly, coal plants were cancelled before they could even be named, due to increasing regulatory scrutiny of long-range integrated resource plans by states such as Oregon and California. * * · *Renewables began elbowing out coal: *Regulators in several states favored utility-scale renewables over coal. In Delaware, regulators cancelled a coal power plant proposed by NRG Energy in favor of an alternative proposal that combined wind and natural gas. In California, the combination of a strict carbon emissions standard and a renewable portfolio standard prompted utilities to enter into contracts for large thermal solar projects sponsored by Ausra, BrightSource, and Solel. ** * * · *Grassroots opposition mounted, financial markets cooled to coal: *After a spate of enthusiasm in 2006, coal plant financiers in 2007 recoiled from escalating construction costs; litigation by environmental groups; and public opposition to coal expressed through rallies, sit-ins, petitions, and local referenda in Texas, Maine, Montana, Utah, Iowa, Minnesota, Virginia, and elsewhere. As sponsors ran into difficulty raising funds, numerous projects were quietly abandoned.** * * · *More plants were abandoned than rejected:* Of the 59 cancelled or sidetracked projects, only 15 were rejected outright by regulators, courts, or local authorities. In the remaining 44 cases, the decision was made by the sponsors themselves. Besides climate concerns, leading reasons for abandoning plants include (1) rapidly rising construction costs, (2) insufficient financing or failure to receive hoped-for government subsidies, and (3) lowered estimates of demand. · *Heavy spending but poor results for "clean coal":* Despite a multi-million dollar advertising campaign by the coal industry in support of its "clean coal" message, the public was unconvinced. An October poll by Opinion Research Corporation<http://www.cleanenergyaction.net/101807_CLEAN_survey_report.pdf>showed that 75 percent of American adults would support a five-year moratorium on new coal plants if funding for renewable alternatives was increased and efficiency standards were tightened. *Background on the Coal Boom* After mainly building natural gas turbines during the 1980s and 1990s, utilities returned to coal when natural gas prices jumped in 2000. In May 2007, the Department of Energy's "Tracking New Coal-Fired Power Plants" (5/07) <http://cmnow.org/NETL%20New%20Coal%205.2007.pdf> study counted 151 proposed coal plants. Vivian It's a good discussion none the less Nice to see you quoted and chosen as source of concern for the global environmental community. The author should have used the quote, (I believe one that you distributed), by the Minister of the Environment for the South African Government when he stated that the Segunda Plant of Salsol is the largest single source of greenhouse gasses on the globe! I am going to try and work this into my talks this week at Shepherd University tomorrow afternoon...two science classes and...then an all campus all student and faculty debate with a nay-slayer (that's not a typo) on Thursday evening. I wanted to be sure you saw this. Not only are we sacrificing our mountains, even more important, we are sacrificing our health. We're sucking this stuff up every day. Mostly it dissipates faster, but the small daily doses are still poisonous. We generate the electricity because the Eastern Seaboard states don't want the expense of shipping coal and they'd rather not have the pollution from generation either. Now they want new transmission lines running thru some of our acreage which has been unspoiled so far. They want us to figure out a way to stop the acid rain from heading north and east. And they want WV ratepayers to pay for the transmission lines too. Meanwhile the WV taxpayer pays to repair our roads after 120,000 lb. plus coal trucks tear them up and we pay big bucks to treat our streams subject to acid mine drainage. This in a state where taxpayers making as little as $10K pay state income tax and the out-of-state landholding companies pay pennies per acre property tax on their resource-rich holdings. Gosh this does sound like a diatribe and I know I'm preaching to the choir.......... Regina

What is NIETC Designation? Sec. 1221 of the 2005 Energy Policy Act provided the Department of Energy the discretion to designate National Interest Electric Transmission Corridors (NIETC) in areas of the United States that are found to be electrically congested. If a project lies within an NIETC, a utility may appeal an unfavorable state decision to the Federal Energy Regulatory Commission for use of federal eminent domain to site the project. Despite receiving over 2,000 comments against the designations, the Department of Energy designated two corridors on October 5, 2007. The first NIETC’s encompass portions of 10 states, 220 counties and impact more than 72 million people. The Department of Energy failed to conduct an alternatives analysis or to consult with the affected states prior to these designations, both requirements of Sec. 1221. Although this policy could be used to provide long distance transmission access to our nation’s developing wind and solar facilities, the Department of Energy has not designated areas of the country that are identified as having significant renewable resources. The Mid-Atlantic NIETC designation will increase transmission infrastructure to coal-fired generation built prior to the 1972 Clean Air Act, facilities that lie outside of the EPA’s non-attainment area for air quality. These investments in unnecessary interstate transmission will make cleaner alternatives such as efficiency and demand response technologies less economically viable. Eight of the ten states in the first NIETC designations have filed Petitions for Rehearing against the Department of Energy’s final decision.
