Activity Description: Commission Final Order granting with respect to the route described as the Preferred Route in Appendix D, as modified by the Grafton Area Route, as further modified that any changes to the scope of project as approved - TrAILCo shall petition the Commission for approval of such changes prior to beginning construction; that TrAILCo is a "public utility" within meaning of W.Va. Code §§24-2-1(a) and 24-2-1 and its activities; consent is granted for TrAILCo to enter into 3 affiliated agreements: service agreement between TrAILCo and Allegheny Energy Service Company; TrAILCo's Capital Contribution Agreement with Allegheny Energy Transmission, LLC; and the Tax Allocation Agreement, as amended, pursuant to W. Va. Code §24-2-12, without approving the specific terms and conditions therein; no further Commission approval is required for issuance of any common stock authorized to be issued under the authority of the FERC and covered by the Capital Contribution Agreement, and the requrements of W. Va. Code §24-2-12a are waived with respect to any common stock that TrAILCo may issue in the future, provided that TrAILCo seeks and obtains such further FERC approvals; provided that this waiver does not constitute a waiver of the requirements of W. Va. Code §24-2-12 or any other sections of the W. Va. Code; within six months of the date of this Order, TrAILCoor its corporate affiliates shall install a static VAR compensator at the Meadow Brook Station; within one year of the date TRIAL is completed and in service, TrAILCo and its corporate affiliates shall submit a plan for reconductoring or otherwise upgrading their respective transmission facilities; CAD Stipulation (Appendix A), Williams Stipulation (Appendix B), and Joint Stipulation (Appendix C) are adopted in resolution of the various issues in this case; the individual provisions of these Stipulations as adopted or modified in Part II.F, Part IV.B.3, Part IV.C, and Part V are adopted as conditions of this Order; TrAILCo is obligated to assess specific lower tower locations and to employ right-of-way maintenance that minimize impacts upon water resources; TrAILCo must obtain and file with this Commisison the indicia of approval for the total length of TrAIL through all other states through wich TrAIL must pass, prior to beginning construction on the project in this state; TrAILCo shall notify Commission when all pre-construction conditions have been met; upon receitp of this notification, Commission will schedule a compliance hearing; TrAILCo may not commence construction until the Commission's review of compliance is complete; pre-construction activity may commence prior to the described hearing; TrAILCo's May 23, 2008 Motion to Re-Route portions of TrAIL near Bahavana Society property is granted; TrAILCo's May 23, 2008 Motion to Re-Route portions of TrAIL near the Williams property is hereby approved subject to TrAILCo submitting verified letters from thos landowners impacted, describing the impact in detail and affirming that the landowners do not object to the revision; Mr. Hildebrand's June 11, 1008 Motion to Reopen the Record to Accept Results of the PJM Study Requested by the Maryland Public Service Commission and Motion to Take Judicial Notice of Testimony to the Maryland Public Service Commission are denied, etc., Case Final, moving from open docket, etc.
