The brief is an excellent summary and a new argument, which is something that will likely peak the interest of the Commissioners. The strength is that it calls into question the financial viability of the TrAIL line, while presenting the Commissioners with an opportunity to exercise their power. I am not sure it will be a compelling argument, because it seems likely that the Commissioners have already made up their mind, but at least, by filing this early, it will force every other intervenor to respond to our arguments, thereby changing the terms of the overall debate.
I think we need to publish something along these lines as a guest editorial, targeting the Coal-To-Liquids proposals out there as well.
